I need to know the legal position of the respective parties to the respective contracts (sale of goods and carriage of goods). Who must pay, referenzcases and sth like that of the following case (bis zum 10.12.2009):

Kwai sells to Mark (English merchant) 3000 tons of Thai White Rice “100% ‘B’ Second grade”, FOB Bangkok Incoterms 2000, US$1,800,000 cash against a clean shipped bill of lading.

Kwai ships all 3000 tons on the “MV Petronas”. It is well known amongst rice traders in Bangkok that the rice is ridden with mites having sat in the warehouses for a long time due to abortive deals in the past and although the rice is still usable it may not be so after the voyage to London. It is simply a rumour and only an expert can tell if it is true or not.

Although the master of MV Petronas himself has heard the rumours he did not pay much attention. Whilst at dock in Bangkok before the ship set sail heavy rainfall wets the bags of rice and as a result the master alters the bill of lading by writing in the margin “cargo wet by rain after loading” before issuing it. The water penetration was due to inadequate sealing of the hatch covers.

Further, during the voyage, the ship encounters a category 5 hurricane ‘Angela’ in the Indian Ocean. To save the ship from capsizing, the crew throws 1000 tonnes of rice off the aft starboard.

Upon arrival at Tilbury (London) whatever is left of the cargo was found to be completely rotted and its only value lies in being used as a fertilizer
